Nothing contained on the Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Website without the written permission of Beast Industries LLC or such third party that may own the Trademarks displayed on the Website. 11. Beast Industries LLC Corporation maintains this product Website (the “Website”) for your personal entertainment, information, education, and communication. You may download material displayed on the Website for non-commercial, personal use only provided you also retain all copyright and other proprietary notices contained on the materials. You may not, however, distribute, modify, transmit, reuse, re post, or use the content of the Website for public or commercial purposes, including the text, images, audio, and video without Beast Industries LLC’s prior written permission. REPRESENTATIONS AND WARRANTIES

SOFTWARE LICENSES
1. You acknowledge and agree that you shall have no rights to the proprietary software and/or any related documentation, enhancements or modifications thereto, provided to you by the Website. You may not sublicense, assign or transfer any licenses granted to you by Beast Industries LLC, and any attempt at such sublicense, assignment or transfer is void. You may make one (1) copy of such software for archival purposes only. You may not copy, distribute, modify, reverse, engineer or create derivative works from the Website Software.
2. Software from this Website is further subject to US Export Controls. No software from this Website may be downloaded or exported (i) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the US has embargoed goods; or (ii) anyone on the US Treasury Department’s list of Specially Designated Nationals or the US Commerce Department’s Table of Deny Orders. By downloading or using the software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
SYSTEM INTEGRITY
1. You may not use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction conducted on the Website. You may not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You may not disclose or share your password with any third parties or use your password for any unauthorized service.
TERMINATION & CANCELLATION
1. Beast Industries LLC may, in its sole discretion, terminate or suspend your access or refuse service at any time, without notice, to all or part of the Service for any or no reason, including, without limitation, breach of these Terms of Service or the repeated infringement of copyrights owned by third parties.
2. Beast Industries LLC, including, without limitation, its authorized agents and employees may terminate your use of the Website without notice in the event that you breach any obligation in these Terms of Service, including but not limited to, (i) restricting, inhibiting or disrupting any Beast Industries LLC event or (ii) attempting to alter or improperly access any feature or function of the Website. Your access may also be subject to termination if you post or transmit any illegal content; harass or threaten any user of the Website or Beast Industries LLC employee; post content (including, but not limited to, the creation of usernames) that is offensive or otherwise disruptive of Website activities; post unsolicited advertising; or improperly impersonate a Beast Industries LLC employee or other individual.
3. Should The Client wish to cancel their membership, they need to do so at least 72 hours before any renewal of their membership by explicitly indicating their intent to have their membership canceled in an email sent to support@thebeastnation.com, sent from the email address they used when signing up for the Service initially.
RISK OF LOSS
1. All items purchased from the Website are made pursuant to a shipment contract. This means that the risk of loss and title for such items passes to you upon our delivery to the carrier.
LIVE EVENTS
1. Your registration
In order to ensure the efficiency of the events, the number of participants is limited. Therefore registrations will be considered in the order of their entrance. Registration must be made via the designated sign-up URL for the respective event and your registration is binding when you submit your registration information to Beast Nation LLC.
Unless otherwise agreed with Beast Nation LLC, you must pay the full participation fee at least 21 calendar days before the beginning of the event. Participants with a payment plan must pay the first installment at least 21 calendar days before the beginning of the event unless otherwise agreed with Beast Nation LLC. You are only entitled to participate in the event if Beast Nation LLC has received your payment within the agreed deadline. Your registration is binding and you cannot cancel your participation and receive a refund after registration. Registrations are personal and not transferable to other people or other events without Beast Nation LLC's prior written consent. Beast Nation LLC reserves the right to refuse to accept your registration without stating reasons.
2. Event details
The event details such as participation fee, date and location are published on the Website but are subject to change as per Section 3. Accommodation and travel costs are not included in the participation fee.
3. Changes in the event program / Cancellation
Wherever possible Beast Nation LLC will not cancel or postpone an event. If, however, for any reason Beast Nation LLC deems it necessary to cancel an event or change the dates, venue, content, title or hours of an event you will be notified as quickly as possible. If an event is canceled, you will receive a full refund of any deposited participation fee. You agree that no further compensation is due for a cancellation or postponement of an event, in particular no compensation for loss of income, travel expenses, or other costs incurred. If you are making any travel plans to attend an event, Beast Nation LLC recommends that you consider travel insurance.
4. Event Materials
Any materials provided by Beast Nation LLC to you during the event (hereinafter "event Materials") are included in the participation fee unless otherwise agreed.
All rights in the event Materials belong to Beast Nation LLC or have been licensed by Beast Nation LLC for the use in the event and are subject to copyright protection. The event Materials are intended only for your personal use. Any reproduction, reprint, translation and transfer to third parties in whole or in part without the express permission from Beast Nation LLC are not permitted. I understand a Beast Industries LLC Live Program, marketing materials related to it, and its content contain copyrights, trademarks, and other original works of Beast Industries LLC, and that any duplication or derivative works is unlawful. I further agree that I will not disclose to any such competing individual or company any of the content I am exposed to at a Beast Industries LLC Live Program or use of the information I learn in a Beast Industries LLC program as the basis for a competing business. This material is confidential, and for my personal private use only.
5. Event recordings
You agree that you will not record any portion of an event.
Beast Nation LLC reserves the right to document the event and record the participants by means of audio recordings, audio-visual recordings and/or photographs. You hereby grant Beast Nation LLC the right and permission to photograph, film, record and/or otherwise capture in any media your name, image, voice, written statement, photograph and/or visual likeness during the event (hereinafter "event Recordings"), without compensation and waiving any inspection or approval rights. The event Recordings shall belong exclusively to Beast Nation LLC and you grant Beast Nation LLC the worldwide, unlimited, sublicensable and transferable right to use the event Recordings at the sole discretion of Beast Nation LLC in whole or in part without compensation to you in any media format (print or electronic) including the right to make the event Recordings, in whole or in part, available via openly accessible websites. You understand that Beast Nation LLC will act in reliance on this permission.
6. Code of conduct
Participants are expected to conduct themselves in a manner required for a successful execution and completion of the event. Any behavior or activity that is disruptive to the event as determined by the event leader or that is in violation of these Terms and Conditions or local law will result in a dismissal of the participant from the event without any right of compensation or refund of the participation fee. I will not collect personal information from, or market to the attendees of Beast Industries LLC Live Programs. I understand that the identities of staff and participants in this Live Program are to be kept confidential. Privacy is important to attendees and staff of Beast Industries LLC Live Programs. I agree to not use any audio or video recording devices during any Beast Industries LLC Live Program that I attend.
7. OtherI understand and agree that the ideas, concepts, techniques and views that I will be exposed to are an opinion only, to be used for personal use purposes only, and not to be considered as professional advice. I agree never to use any of the content that I learn in an unlawful manner. I shall not hold Beast Industries LLC or its principal shall not be liable in any way whatsoever for any damages as a result of using or my inability to use the concepts I learn at this training and other third-party providers used, or any other product or service you are exposed to as a result of my relationship with Beast Industries LLC. I agree to forgo litigation and settle the matter using Binding Arbitration if a conflict should arise between Beast Industries LLC (including its staff and Principal) and I. Beast Industries LLC retains the right to refuse service and training to anyone at our discretion.
VIRTUAL COACHING/PROGRAMS
Beast Industries LLC and The Client mutually recognize that they may discuss The Client’s future plans, business affairs, customer lists, financial information, job information, goals, personal information, and other private information. Beast Industries LLC will not voluntarily communicate The Client’s information to a third party. In order to honor and protect Beast Industries LLC’s intellectual properties, The Client expressly agrees not to disclose or communicate any proprietary information about Beast Industries LLC’s practice, materials, or methods to any third parties. Beast Industries LLC and The Client agree to be bound by this mutual nondisclosure agreement during and after the termination of the Coaching relationship.
PRODUCT DESCRIPTIONS
1. Beast Industries LLC and its affiliates attempt to describe all of the products on the Website as accurately as possible. However, Beast Industries LLC does not warrant that product descriptions or other Content of this Website is accurate, complete, reliable, current or error-free. If a product offered on our Website itself is not as described, your sole remedy is to return it in unused condition.
MISCELLANEOUS
1. This Agreement has been made in and shall be construed and enforced in accordance with the law without regard to any conflict of law provisions. Beast Industries LLC makes no representation that the Content in this Website is appropriate for access outside of the US. Those who choose to access this Website from outside the US do so on their own initiative and are responsible for compliance with local laws. You agree that any action to enforce this agreement shall be brought in the federal or state courts located in Texas.
2.Beast Industries LLC may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.

These Terms of Service, the Privacy Statement and any other terms referenced in this Agreement constitute the entire agreement between you and Beast Industries LLC with respect to your access and use of the Website and Services and supersede all prior or contemporaneous agreements (whether oral, written or electronic) between you and Beast Industries LLC with respect to this Website or Services. If any of the provisions of this Agreement are determined to be invalid or unenforceable, then each invalid or enforceable provision will be construed in a manner consistent with applicable laws to reflect, as nearly as possible, the original intentions of the parties, and the remaining provisions shall remain in full force and effect. Beast Industries LLC may assign these Terms of Service (i) to any of its affiliates, (ii) to the surviving entity in the event of a merger, acquisition, or the sale of all or substantially all of the assets of Beast Industries LLC or (iii) in connection with the sale of this Website or the business unit associated with this Website.
5. In the event that you violate any of the above terms, you agree to pay Beast Industries LLC the sum of $10,000.00 as liquidated damages. You further agree that all payments made to Beast Industries LLC are forfeited and not subject to refund. The only exception being, if you went through all the available resources and are not satisfied with the value provided, let us know via email (support@thebeastnation.com) within the first 30 days of initially signing up and we will offer you a full refund of what you paid when you signed up. The only other requirement is that you show us that you fully completed all the assignments within the first 30 days, and thus gave the program a fair chance.
